This is one of a number of aspects of the Land Reform (Scotland) Act 2003 (LRSA) which may contravene the conventions of the Human Rights Act 1988.
As I understand it, the LRSA is an act of a non-sovereign parliament and, if it is proven to contravene human rights, may be open to repeal by the courts.

Hide AdIf the Cairngorm National Park Authority feels it can justify the use of limited public funds to provide a designated route for the walking public over and above the rights afforded under the LRSA it would be more equitable for them to take their chance on the open market when suitable land becomes available for sale.
